NESPELEM – The Colville Tribes’ Office of Reservation Attorney has opened for a 90-day comment period a proposed amendment  to the Colville Tribal Code that would add Chapter 9-7 related to eminent domain.

“The Tribes has never relinquished its sovereign authority to exercise eminent domain on the Reservation, the North Half, or any allotments wherever located,” reads the cover sheet, published here. “Eminent domain is the authority of the Tribes to condemn (take) property for public purposes.”

The Colville Tribal Code Chapter 9 relates to property.

The comment period closes April 23.
